AGREEMENT TO TERMS
By accessing or using Cleviro's services at cleviro.io you agree to be bound by these Terms of Service. If you do not agree to these terms do not use our services. These terms apply to all visitors, users, and clients of Cleviro.
ABOUT CLEVIRO
Cleviro is an AI agent service that answers missed calls for contractors and local service businesses, captures lead information, and delivers real-time SMS notifications to business owners. Cleviro is operated by Cleviro Inc, based in Montreal, Quebec, Canada.
SERVICES
Cleviro provides the following services:
Custom AI voice agent built for your business
Inbound missed call answering using your business name
Lead capture including caller name, phone number, address, and job type
Real-time SMS notifications sent to the business owner
Setup, configuration, and ongoing monitoring of your AI agent
Support directly from the Cleviro team
The specific services provided to you are outlined in your service agreement at the time of signup.
FREE TRIAL
Cleviro offers a 30-day free trial to new clients. During the free trial period:
No credit card is required to get started
You will not be charged anything during the trial period
The trial begins on the date your AI agent goes live
You may cancel at any time during the trial with no obligation
PAYMENT TERMS
After your free trial period ends:
The standard monthly rate is $399 USD per month
Billing is month to month with no long-term contract required
Payment is due at the start of each billing cycle
Cleviro accepts payment via credit card and other methods as made available
You may cancel your subscription at any time before the next billing cycle to avoid being charged
GUARANTEE
Cleviro offers the following guarantee to all clients:
If Cleviro does not recover at least one real missed job for you during your first 30 days of service you will not be charged anything.
Additionally if Cleviro recovers missed jobs during your trial but you do not find the service useful after 30 days you will not be charged anything.
This guarantee applies to your first 30 days only. After the trial period standard monthly billing applies.
A recovered missed job is defined as a call that was answered by the Cleviro AI agent, a lead was successfully captured, and the lead information was delivered to the business owner via SMS.
CANCELLATION
You may cancel your Cleviro subscription at any time by:
Contacting the Cleviro team directly at hello@cleviro.io
Providing written notice of cancellation before your next billing date
Cancellations take effect at the end of your current billing cycle. No refunds are provided for partial months after billing has occurred.
CLIENT RESPONSIBILITIES
As a Cleviro client you agree to:
Provide accurate business information during onboarding including your business name, services, and operating hours
Set up call forwarding to your Cleviro number as instructed during onboarding
Notify Cleviro of any changes to your business information, services, or hours that would affect how your AI agent operates
Use the service only for lawful business purposes
Not attempt to reverse engineer, replicate, or resell Cleviro's technology or services
ACCEPTABLE USE
You agree not to use Cleviro's services to:
Engage in any illegal activity
Deceive or mislead callers in any way that causes harm
Violate any applicable laws or regulations in your jurisdiction
Infringe on the intellectual property rights of any third party
Transmit any harmful, offensive, or inappropriate content
Cleviro reserves the right to suspend or terminate your account immediately if you violate these acceptable use terms.
PRIVACY AND DATA
Cleviro collects and processes call data including caller names, phone numbers, addresses, and job information in order to provide the service. This data is:
Used solely to deliver the Cleviro service to you and your callers
Delivered to you via SMS notification
Stored securely and not sold to any third party
Subject to our Privacy Policy available at cleviro.io/legals/privacy-policy
By using Cleviro you consent to the collection and processing of call data as described in our Privacy Policy.
CALL RECORDING AND CONSENT
Cleviro's AI agent may record calls for quality assurance and service improvement purposes. It is your responsibility as the business owner to ensure that call recording complies with applicable laws in your jurisdiction. In some jurisdictions you are required to inform callers that a call is being recorded. Cleviro provides tools to include disclosure language in your AI agent's greeting. You are solely responsible for ensuring compliance with all applicable recording consent laws.
INTELLECTUAL PROPERTY
All technology, software, systems, scripts, and processes used to deliver Cleviro's services are the intellectual property of Cleviro. Nothing in these terms transfers any intellectual property rights to you. You retain ownership of your business information and lead data captured through the service.
THIRD PARTY SERVICES
Cleviro uses third party services to deliver its platform including voice technology providers, SMS delivery providers, and cloud infrastructure providers. Cleviro is not responsible for any outages, delays, or failures caused by third party service providers. We will make reasonable efforts to notify clients of any significant service disruptions.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law:
Cleviro's total liability to you for any claim arising out of or relating to these terms or the service shall not exceed the amount you paid to Cleviro in the three months preceding the claim.
Cleviro is not liable for any indirect, incidental, special, consequential, or punitive damages including lost profits, lost revenue, or lost business opportunities even if Cleviro has been advised of the possibility of such damages.
Cleviro does not guarantee that the service will be uninterrupted, error-free, or that every missed call will be captured. The service is provided on an as-is and as-available basis.
INDEMNIFICATION
You agree to indemnify and hold harmless Cleviro, its founders, employees, and agents from any claims, damages, losses, or expenses including legal fees arising out of your use of the service, your violation of these terms, or your violation of any applicable law or regulation.
DISCLAIMER OF WARRANTIES
Cleviro provides its services as-is without any warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Cleviro does not warrant that the service will meet your specific business requirements or that results will be guaranteed beyond the terms of the 30-day guarantee outlined in Section 4.
CHANGES TO TERMS
Cleviro reserves the right to modify these Terms of Service at any time. We will notify active clients of any material changes via email at least 14 days before the changes take effect. Your continued use of the service after changes take effect constitutes your acceptance of the updated terms.
TERMINATION
Cleviro reserves the right to suspend or terminate your access to the service at any time for any of the following reasons:
Violation of these Terms of Service
Non-payment of fees
Fraudulent or abusive use of the service
At our discretion with 30 days written notice
Upon termination you will lose access to the service and any stored data associated with your account.
GOVERNING LAW
These Terms of Service are governed by the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Montreal, Quebec, Canada.
ENTIRE AGREEMENT
These Terms of Service together with our Privacy Policy constitute the entire agreement between you and Cleviro regarding the use of our services and supersede any prior agreements or understandings.
